Terms & Conditions
1. Acceptance of Terms
By accessing or using Savshka Communication’s ("Company," "we," "our") CPaaS platform (the "Service"), you ("Customer," "User") agree to comply with these Terms. If you represent an entity, you warrant authority to bind them.
2. Service Description
- Cloud-based communication APIs (SMS, Voice, Email, etc.).
- Developer tools, analytics, and related infrastructure.
- Support as per selected subscription plan.
Service features may evolve; we’ll notify Users of material changes.
3. Account Registration
- Eligibility: Must be 18+ or a legally registered entity.
- Accuracy: Provide truthful information; maintain updated details.
- Security: You’re responsible for login credentials and account activity.
4. Acceptable Use Policy (AUP)
Prohibited Activities Include:
- ❌ Illegal content (spam, fraud, harassment).
- ❌ Reverse-engineering or reselling APIs without permission.
- ❌ High-risk use (e.g., emergency services) unless explicitly approved.
Violations may result in immediate suspension.
5. Fees & Payments
- Pricing: As per selected plan on our website or contract.
- Billing Cycle: Monthly/annually, auto-renewed unless canceled.
- Taxes: Exclusive of GST/VAT (added to invoices).
- Refunds: Only for prepaid unused services if terminated per Section 7.
6. Service Level Agreement (SLA)
- Uptime: 99.9% (excludes maintenance, force majeure).
- Support: Email/ticketing system (response within 24 business hours).
- Credit policy for downtime detailed in separate SLA.
7. Termination
- By You: 30-day written notice; settle outstanding fees.
- By Us: For breach (AUP, non-payment) with 15-day cure period.
- Effect: Data retrieval possible for 30 days post-termination.
8. Intellectual Property
- Company Ownership: All software, trademarks, and documentation.
- Customer Ownership: Your content/data transmitted via our APIs.
- License: We grant limited, non-exclusive API access during active subscription.
9. Data Privacy & Compliance
Our Commitments: As per our Privacy Policy.
Your Obligations:
- Obtain consent for end-user data shared with us.
- Comply with telecom regulations (TRAI, GDPR, TCPA).
10. Limitation of Liability
- Cap: Liability limited to fees paid in the preceding 6 months.
- Exclusions: We’re not liable for:
- Third-party carrier issues.
- Indirect damages (lost profits, data loss).
11. Indemnification
You agree to defend and indemnify us against claims arising from:
- Your misuse of the Service.
- Violation of laws (e.g., spam regulations).
12. Governing Law & Disputes
- Jurisdiction: Courts in Noida, India.
- Arbitration: Mandatory for disputes (except injunctive relief).
13. Force Majeure
Not liable for delays/cancellations due to:
- Natural disasters.
- Government actions.
- Telecom carrier failures.
14. Amendments
We may update these Terms; continued use constitutes acceptance. Major changes will be notified via email.
